Let's get this thing started. 今日はYUGOが来てるぞ!簡単に自己紹介よろしく! So you guys are finally here. Can you just tell us a little bit about yourself? YUGOと言います。YUGO ISHIBASHIです。 Hi. I like to consider myself as a trial lawyer. 刑事事件を多く扱っています Okay. 今日は日本の司法制度についてご説明したいと思います And I'm doing a lot of criminal cases. So today, I would like to explain you about the Japanese justice system. まず、外国人が逮捕されることが多いケースについて、色々聞く前に So maybe before we like start about all of the different situations 日本の司法制度がどのように執行されるのか、簡単に教えてくれますか that foreigners could get themselves arrested for. わかりました Maybe you can kind of like share with me how the justice system まず、逮捕されると、警察に身柄を拘束されますよね overall kind of works here in Japan. 拘束時間は最長72時間 Okay. その72時間の間に、警察は勾留するかしないかを決めます So, if you get arrested: 検察官が提出する勾留申請が認められると、10日間の勾留が決まります Police will get you in custody for 72 hours. この勾留期間はさらに10日間延長ができるので And within that 72 hours, they have to decide whether to detain you or not. 全て合わせると最長23日間も拘束され続けることになるんです The prosecutor will file a request and if the judge approves such a request then you'll get detained for 10 days. もし外国人で永住権を持っていない場合 (その23日間に検察官が起訴するかの判断をし、起訴された場合刑務所に送られます) And this 10 days. It could be extended for 10 more days. 23日間身柄拘束される可能性は高いです So in total, the detainment will last 23 days and if you're a foreigner and you don't have a permanent residency. 一つの犯罪につきです It's likely that you'll get arrested and get detained for 23 days for one crime. もちろん、別の犯罪を犯して、その件に対しても逮捕されているのなら Of course, if you have committed another crime and if they arrest you for that, that will be 46. 46日間拘束されることになります So, if you say you like shoplift and then you also assaulted someone. じゃあ、もし万引きと暴行をした場合は46日間? No. 通訳がいるけども、それでも23日は… So, basically they'll just interrogate you for 3 days. とんでもなく長い期間だと思います Yes. 仕事をクビになってしまう人もいるし、家族を失う人もいます And within the 3 days, if they don't charge you with a crime. その23日間に起こることに関してですが、 Then, they have to let you go right? 警察によって取り調べが行われるんです Or they ask you for detainment up to 20 days. その間メールも電話もできません 10 days plus 10 days. 日本の法律に黙秘権はありますが、取り調べを受けることも義務なんです What happens if you don't speak the language. 私が知る限り、他国で黙秘権がある場合、取り調べを受ける必要はないんですよね Well, there's an interpreter, but 23 days, it's-I think it's outrageous. とても変わってるんですよ Some people lose their jobs...lose their families. つまり、取り調べ中、警察官に同じ部屋にずっといなければならないんです What happens during that 23 days? 質問をされ続けるし、プレッシャーを与えてくることだってあります Yeah. 「罪を認めた方が楽だぞ」って促されたり、責め立てられるんですよね The police will do some investigation and you'll get interrogated. 黙秘権があっても、それを使うのは難しいんです No emails, no telephone, and although, you have the right to remain silence. それからもう一つ In Japan, the authorities construe that you have to be there when the officer questions you. 日本では取り調べに弁護士が立ち会うことはできません So, there's difference because my understanding is other countries: 他国では弁護士が立ち会いますよね If you have the right to remain silent, you don't have to go through the interrogation.
