when I was a barrister and human rights lawyer

20年前

in full-time legal practice in London,

私が法廷弁護士・人権派弁護士として

and the highest court in the land

ロンドンで働いていた頃のことです

still convened, some would say by an accident of history,

当時の裁判で 最終審が行われていたのは—

in this building here,

「歴史のいたずら」 とでも言いましょうか—

I met a young man who had just quit his job

まだ この建物でした

in the British Foreign Office.

ある日 英国外務省の仕事を 辞めたばかりの

When I asked him, "Why did you leave,"

若い男性と知り合いました

he told me this story.

辞めた理由を尋ねると

He had gone to his boss one morning and said,

事情を話してくれました

"Let's do something about human rights abuses in China."

ある朝 上司の元へ行き

And his boss had replied,

「中国での人権侵害問題について 何かしたいのですが」と言うと

"We can't do anything about human rights abuses in China

こう言われたそうです

because we have trade relations with China."

「我々には何もできないよ

So my friend went away with his tail between his legs,

中国とは交易関係があるからね」

and six months later, he returned again to his boss,

その日は すごすごと引き下がったものの

and he said this time,

半年後 再び上司の元に行き

"Let's do something about human rights in Burma,"

今度はこう言いました

as it was then called.

「ビルマでの人権問題について 何かしたいのですが」

His boss once again paused

「ビルマ」は当時の国名です

and said, "Oh, but we can't do anything about human rights in Burma

上司は 少し考えましたが 答えは同じでした

because we don't have any trade relations with Burma."

「いや 我々には何もできないな

(Laughter)

ビルマとは交易関係がないんだから」

This was the moment he knew he had to leave.

（笑）

It wasn't just the hypocrisy that got to him.

これを聞いて 辞職を決めたそうです

It was the unwillingness of his government

外交とは名ばかりであることだけでなく

to engage in conflict with other governments,

罪のない人々が不当な扱いを 受けているのをよそに

in tense discussions,

他国政府との対立関係や 緊迫した議論を避けようとする—

all the while, innocent people were being harmed.

政府の態度にも 嫌気がさしたのでした

We are constantly told

私たちはしょっちゅう

that conflict is bad

対立は悪いことだが

that compromise is good;

妥協は善いことだとか

that conflict is bad

対立は悪いことだが

but consensus is good;

合意は善いことだとか

that conflict is bad

対立は悪いことだが

and collaboration is good.

協力は善いことだ などと言われます

But in my view,

でも 私に言わせれば

that's far too simple a vision of the world.

そんなに世の中 単純じゃありません

We cannot know

対立が悪いことなのかどうかを

whether conflict is bad

判断するためには

unless we know who is fighting,

誰を相手に なぜ対立していて

why they are fighting

どのような手段を取っているのか

and how they are fighting.

知る必要があります

And compromises can be thoroughly rotten

腐りきった汚い妥協もあり得ます

if they harm people who are not at the table,

話し合いの場にいない人や

people who are vulnerable, disempowered,

弱い立場の人 力を持たない人

people whom we have an obligation to protect.

守るべき対象である人々に 害をもたらす場合です

Now, you might be somewhat skeptical of a lawyer

さてここで 対立を善しとし

arguing about the benefits of conflict

妥協を問題視する弁護士は 何だか怪しいと

and creating problems for compromise,

思う方もいるかもしれませんが

but I did also qualify as a mediator,

私には調停委員の資格もあり

and these days, I spend my time giving talks about ethics for free.

最近は倫理学の講演も 無料でやっています

So as my bank manager likes to remind me, I'm downwardly mobile.

銀行の担当者によく言われますが 落ちぶれてきているわけです

But if you accept my argument,

しかし 私の主張を 受け入れていただければ

it should change not just the way we lead our personal lives,

まず 自分自身の人生の 歩み方が変わるはずです

which I wish to put to one side for the moment,

この話は また後でしますが

but it will change the way we think about major problems

それだけでなく 公衆衛生や地球環境など

of public health and the environment.

大きな問題に対する 考え方も変わるでしょう

Let me explain.

どういうことか説明します

Every middle schooler in the United States,

アメリカの中学生は必ず—

my 12-year-old daughter included,

私の12歳の娘もですが—

learns that there are three branches of government,

政府には３つの部門があると習います

the legislative, the executive and the judicial branch.

立法府 行政府 司法府です

James Madison wrote,

ジェームズ・マディソン曰く

"If there is any principle more sacred in our Constitution,

「我らが合衆国憲法の中で 何よりも神聖なる理念があるとすれば—

and indeed in any free constitution,

これは事実 いかなる自由な憲法にも

than any other,

当てはまることだが—

it is that which separates

the legislative, the executive and the judicial powers."

Now, the framers were not just concerned

この仕組みは 権力の集中や行使のみに配慮して

about the concentration and exercise of power.

考案されたのではありません

They also understood the perils of influence.

中立性を保つという意図もあります

Judges cannot determine the constitutionality of laws

つまり 裁判官が法律の策定に 関わっていたとしたら

if they participate in making those laws,

その法律の合憲性を 判断することはできません

nor can they hold the other branches of government accountable

もしくは 他の部門と 協力し合ったり

if they collaborate with them

密な関係にあったとしたら

or enter into close relationships with them.

その部門に 責任を問うことはできません

The Constitution is, as one famous scholar put it,

憲法とは 有名な学者の言葉を借りれば

"an invitation to struggle."

「争いへの招待」なのです

And we the people are served

政府が私たち民衆のために 働いていると言えるのは

when those branches do, indeed, struggle with each other.

やはり これらの部門が 拮抗状態にあるときなのです

Now, we recognize the importance of struggle

このように 争いが重要であるという考え方は

not just in the public sector

公共セクターに限ったものではありません

between our branches of government.

政府の部門同士だけの話ではないのです

We also know it too in the private sector,

民間セクターにおける企業同士の 争いの重要性も よく知られています

in relationships among corporations.

例えば アメリカの航空会社のうち ２社が談合して

Let's imagine that two American airlines get together and agree

エコノミークラスの運賃を

that they will not drop the price

250ドル以下にはしないという 合意に至ったとします

of their economy class airfares below 250 dollars a ticket.

これは協力です 結託と呼ばれることもあります

That is collaboration, some would say collusion,

競争ではありません

not competition,

私たち民衆に害をもたらすものです

and we the people are harmed

航空券が高くなるからです

because we pay more for our tickets.

同じように ２社が こう示し合わせたとします

Imagine similarly two airlines were to say,

A社「LAとシカゴの間のルートは 我が社が担当します」

"Look, Airline A, we'll take the route from LA to Chicago,"

B社「では我が社は シカゴと ワシントンDCの間を担当して

and Airline B says, "We'll take the route from Chicago to DC,

競争は避けましょう」

and we won't compete."

これもやはり 協力または結託であり 競争が起こらないので

Once again, that's collaboration or collusion instead of competition,

私たち民衆に害が及ぶのです

and we the people are harmed.

さて 争いが重要であるという考え方は

So we understand the importance of struggle

政府の部門同士の関係 という文脈では常識です

when it comes to relationships between branches of government,

つまり公共セクターですね

the public sector.

これはまた 企業同士の関係という 文脈でも同じです

We also understand the importance of conflict

こちらは民間セクターです

when it comes to relationships among corporations,

この認識が抜けてしまっているのが

the private sector.

公共と民間の関係という文脈です

But where we have forgotten it

世界各国の政府は産業と協力して

is in the relationships between the public and the private.

公衆衛生や環境といった問題に 取り組んでいますが

And governments all over the world are collaborating with industry

解決しようとしている問題を 作り出し 拍車をかけている—

to solve problems of public health and the environment,

張本人である企業と 協力している場合が多いのです

often collaborating with the very corporations

この協力関係は 双方が得をする 「Win-Win」な関係だと

that are creating or exacerbating the problems they are trying to solve.

言われていますが

We are told that these relationships

実は誰かが損をしているとしたら？

are a win-win.

例を挙げて説明しましょう

But what if someone is losing out?

ある国連機関が 重大な問題を提起しようとしました

Let me give you some examples.

インドの田舎にある学校での 劣悪な衛生環境についてです

A United Nations agency decided to address a serious problem:

実施にあたって インド政府や その地方の自治体

poor sanitation in schools in rural India.

さらに テレビ局や

They did so not just in collaboration with national and local governments

大手の多国籍飲料会社の 協力を得ました

but also with a television company

100万ドルに満たない投資の見返りに

and with a major multinational soda company.

この飲料会社は 何ヶ月にもわたる 宣伝活動の恩恵を受けました

In exchange for less than one million dollars,

12時間テレビも その１つです

that corporation received the benefits of a months-long promotional campaign

あちこちに会社のロゴや テーマ色を使っての活動でした

including a 12-hour telethon

このようなやり方は

all using the company's logo and color scheme.

企業の立場からすれば

This was an arrangement

当然と言ってもいいでしょう

which was totally understandable

会社のイメージアップや

from the corporation's point of view.

ブランド・ロイヤルティの 構築にもつながります

It enhances the reputation of the company

しかし私は これが

and it creates brand loyalty for its products.

環境に優しい生き方を 推進するというミッションを持つ—

But in my view,

政府間機関にとっては 深刻な問題であると考えています

this is profoundly problematic for the intergovernmental agency,

希少な現地の水に 砂糖で甘く味付けして

an agency that has a mission to promote sustainable living.

ペットボトルに入れて 売っている飲料の消費を

By increasing consumption of sugar-sweetened beverages

既に肥満の問題と 奮闘している国で増やすこと自体

made from scarce local water supplies and drunk out of plastic bottles

公衆衛生と環境 どちらの観点から見ても

in a country that is already grappling with obesity,

将来への配慮に欠けています

this is neither sustainable from a public health

公衆衛生問題を１つ解決するために

nor an environmental point of view.

また別の問題の種を 蒔いているというわけです

And in order to solve one public health problem,

今のは 政府と産業との関係について 本を書くにあたり

the agency is sowing the seeds

調査する中で発見した 何十件もの事例うち ほんの一例です

of another.

同じ会社が関わった 別の取り組みの例もあります

This is just one example of dozens I discovered

ロンドンやイギリス全土の公園を舞台に

in researching a book on the relationships between government and industry.

体を動かそうと呼びかける というものです

I could also have told you about the initiatives in parks

他にも それこそイギリス政府は 自発的誓約を作成するのに

in London and throughout Britain,

産業と提携していましたしね

involving the same company, promoting exercise,

逆に規制すべきでしょう

or indeed of the British government creating voluntary pledges

産業との協力や提携は いまや 公衆衛生において典型と化しています

in partnership with industry

これも産業側の立場からすれば もっともなことです

instead of regulating industry.

公衆衛生問題やその解決策の見方を 自社利益への脅威が最小で

These collaborations or partnerships have become the paradigm in public health,

自社利益と最も調和の取れるような方向に

and once again, they make sense from the point of view of industry.

誘導できるのですから

It allows them to frame public health problems and their solutions

こうして 肥満の原因が

in ways that are least threatening to,

「個人の判断力の欠如」や

most consonant with their commercial interests.

「個人の行動の問題」や

So obesity becomes a problem

「自己責任」そして「運動不足」に されてしまうのです

of individual decision-making,

このような見方をすれば

of personal behavior,

大企業が関わる—

personal responsibility and lack of physical activity.

国をまたいだ食料供給システムに 不備があるということにはなりません

It is not a problem,

産業側にすれば仕方のないことです

when framed this way,

産業というものは本来 物事を自社に得になるように

of a multinational food system involving major corporations.

動かすための戦略を展開するものです

And again, I don't blame industry.

しかし政府には それに対抗する戦略を

Industry naturally engages in strategies of influence

立てるという責任があります

to promote its commercial interests.

私たち国民を守り

But governments have a responsibility

公益を守るためです

to develop counterstrategies

このようなやり方で 産業と協力して活動した場合に

to protect us

政府が犯している間違いとは

and the common good.

２つの概念を

The mistake that governments are making

一緒くたにしていることです

when they collaborate in this way

「公益」と

with industry

「共通基盤」です

is that they conflate

産業と協力関係にある場合

the common good

公益を促進するかもしれないが

with common ground.

産業側が賛同できないような議題は どうしても避けてしまいます

When you collaborate with industry,

例えば産業は 規制の強化には 合意しないでしょう

you necessarily put off the table

規制により 更に多くの 規制を回避したり

things that might promote the common good to which industry will not agree.

競合他社を市場から蹴落とせるという 確信のある場合は別ですが

Industry will not agree to increased regulation

しかし 企業同士が合意しては いけないこともあります

unless it believes this will stave off even more regulation

健康に悪い製品の価格を 上げることがその１つです

or perhaps knock some competitors out of the market.

先ほども説明したように

Nor can companies agree to do certain things,

競争法に反しますからね

for example raise the prices of their unhealthy products,

ですから 政府は 「公益」と「共通基盤」を

because that would violate competition law,

混同してはなりません

as we've established.

「共通基盤」が産業との合意に 達することを意味する場合は尚更です

So our governments should not confound

もう１つ 例を挙げましょう

the common good and common ground,

先ほどのは 表立った協力の事例でしたが

especially when common ground means reaching agreement with industry.

今度は 地下で起こっていることです

I want to give you another example,

文字通り そして 比喩的な意味でもです

moving from high-profile collaboration

水圧粉砕による天然ガスの生産です

to something that is below ground

あなたが 土地を一画 買ったとしましょう

both literally and figuratively:

その区画の採掘権が売却済みだとは 知らずにです

the hydraulic fracturing of natural gas.

フラッキングのブーム到来前の話です

Imagine that you purchase a plot of land

買った土地に念願のマイホームを建てて

not knowing the mineral rights have been sold.

その後 間もなく

This is before the fracking boom.

ガス会社が自分の土地に 坑井を作っていることが発覚します

You build your dream home on that plot,

このような苦境に置かれたのが ハロウィッチ一家です

and shortly afterwards,

非常に短い期間の間に

you discover that a gas company is building a well pad on your land.

一家は 頭痛や喉の痛み 目のかゆみを訴え始め

That was the plight of the Hallowich family.

さらに 騒音や振動

Within a very short period of time,

天然ガスが噴出した際の 閃光にも悩まされました

they began to complain of headaches,

強く苦情を申し立てていたのですが

of sore throats, of itchy eyes,

ある時から 大人しくなりました

in addition to the interference of the noise, vibration

この写真の出元である ピッツバーグの地方紙と

and the bright lights from the flaring of natural gas.

もう１紙が取り上げたおかげで その理由が分かりました

They were very vocal in their criticisms,

この２社が 一家に何があったのか 裁判所で情報請求したところ

and then they fell silent.

ガス採掘会社との間に ひっそりと示談が 成立していたことが判明しました

And thanks to the Pittsburgh Post-Gazette, where this image appeared,

しかも一方的な条件でした

and one other newspaper, we discovered why they fell silent.

ガス会社は一家に

The newspapers went to the court and said, "What happened to the Hallowiches?"

よそに引っ越して やり直すための 多額の補償金を提供する代わりに

And it turned out the Hallowiches had made a secret settlement

ガス会社との間にあったことを 公表してはならず

with the gas operators, and it was a take-it-or-leave-it settlement.

フラッキングに関する 体験を語ってはならず

The gas company said,

病院での検査から分かった 健康への影響があっても

you can have a six-figure sum

口にしてはならないという 条件を突きつけたのです

to move elsewhere and start your lives again,

ハロウィッチ一家が この一方的な示談に

but in return

同意して よそでやり直すという

you must promise not to speak of your experience with our company,

決断をしたことを 悪いとは思いません

not to speak of your experience with fracking,

また 会社側の

not to speak about the health consequences

うるさい住民を黙らせたいと いう意向も理解できます

that might have been revealed by a medical examination.

私が責任を問いたいのは 法や規制の仕組みです

Now, I do not blame the Hallowiches for accepting

この仕組みは たくさんの合意が 集まって できています

a take-it-or-leave-it settlement

今お話ししたような

and starting their lives elsewhere.

人々の口を封じ 公衆衛生や疫学の専門家が

And one can understand

データを取る対象を 封鎖してしまうような合意もです

why the company would wish to silence a squeaky wheel.

この仕組みの下では

What I want to point the finger at is the legal and regulatory system,

公害があったとしても 地主とガス会社の間で

a system in which there are networks of agreements

示談が成立すれば

just like this one

規制機関は 違反の通告すら

which serve to silence people and seal off data points

自重してしまいます

from public health experts and epidemiologists,

この仕組みは 公衆衛生の観点から 望ましくないというだけではなく

a system in which regulators

何も知らされることのない地域住民を

will even refrain from issuing a violation notice

危険にさらすことにもなります

in the event of pollution

私が挙げた２つのケースは 単独の事例ではありません

if the landowner and the gas company

制度全体の問題を表したものです

agree to settle.

反対事例を挙げることもできますよ

This is a system which isn't just bad from a public health point of view;

公的機関が 製薬会社を相手に

it exposes hazards to local families

訴訟を起こしたケースもあります

who remain in the dark.

思春期に抗うつ薬を与えると

Now, I have given you two examples not because they are isolated examples.

自殺を考えやすくなるという事実を 隠ぺいしていたためです

They are examples of a systemic problem.

食品会社を相手に戦った 規制機関もあります

I could share some counterexamples,

健康食品として 自社製品のヨーグルトの 効能を誇張したためです

the case for example of the public official

他にも 両政党にかかった—

who sues the pharmaceutical company

大きな圧力にも負けず 環境保護を押し進める—

for concealing the fact

国会議員の話を することもできます

that its antidepressant increases suicidal thoughts in adolescents.

それぞれは単独の事例ですが

I can tell you about the regulator who went after the food company

暗闇に灯る一筋の光のような存在であり
